Court orders community service for three in Kulgam public nuisance case

Kulgam, Jan 21, KNT: In a move reflecting the reformative spirit of the newly introduced Bharatiya Nyaya Sanhita, a local court in Kulgam has awarded punishment of community service to three individuals for disturbing public peace while under the influence of alcohol.

The Judicial Magistrate of First Class, Kulgam, sentenced the accused after finding them guilty of creating public nuisance while intoxicated. The individuals were booked by Police Station Kulgam under Section 355 of the Bharatiya Nyaya Sanhita for causing disturbance in a public place.

The convicted persons have been identified as Mubarak Ahmad Dar son of Ghulam Hassan Dar of Bogund, Arif Ahmad Ganie son of Mushtaq Ahmad Ganie of Bogund, and Bilal Ahmad Ahanger son of Mohammad Yousuf Ahanger of Tuli Nowpora.

Following the conclusion of the trial, the court directed the three to perform community service involving cleaning and maintenance of hygiene at the Tehsil and Sub-District Hospital Qaimoh for a period of ten days. The court observed that such non-custodial punishment promotes accountability while offering offenders an opportunity to contribute positively to society.

The order is in line with recent criminal law reforms that allow minor offences to be addressed through corrective and community-oriented measures instead of imprisonment, with an emphasis on reformation and reintegration.
