Court restrains Sheikh Imran from running ‘media trial’ against Srinagar Deputy Mayor

A local court has temporarily restrained the former Srinagar Deputy Mayor Sheikh Imran from publishing any defamatory content rather remarks in print or electronic media against the incumbent Deputy Mayor Parvaiz Qadri.

The court of 2nd Additional District Judge Srinagar passed the directions after hearing the arguments of Advocate Shazada Saleem and Advocate Feroz Ahmed Parray representing the applicant Parvaiz Qadri.

The plaintiff Parvaiz Qadri through his lawyers had submitted an application for a grant of temporary injunction. The application filed in the court of law stated that incumbent Srinagar Deputy Mayor Parvaiz Qadri is a respectable elected representative of the people and currently occupying the post of Deputy Mayor Srinagar Municipal Corporation while the former Deputy Mayor Sheikh Imran is hell-bent to tarnish his image and is giving defamatory statements in media with an intention to derogate the goodwill and reputation of the plaintiff (Parvaiz Qadri).

“The defendant (Sheikh Imran) has made false allegations in writing on social media as well as by verbally disseminating the plaintiff to various media houses in furtherance of his nefarious agenda to defame and tarnish the goodwill held and enjoyed by the plaintiff in the eyes of the public at large,” reads the application.

The application as per news agency Kashmir News Trust further reads that the cause of action for filing the instant suit arose on 15th October 2022, when the defendant posted a video on his Twitter account wherein the defendant left no stone unturned in maligning the image of Parvaiz Qadri.

The Counsels for the plaintiff stated that the defamatory statements have caused immense loss and damage to the plaintiff which can’t be measured in pecuniary terms alone.

“Plaintiff prayed for a decree of mandatory injunction against the defendant restraining him from directly or indirectly making or publishing derogatory and defamatory remarks against the plaintiff and also an award directing the defendant to pay a sum of Rs 5 Crores to the plaintiff as damages against caused to the plaintiff.”

After hearing the Counsels for the plaintiff the court of 2nd Additional District Judge Srinagar maintained that the plaintiff has been able to establish the prima-facie case at this stage for grant of ex-parte interim relief.

The court asked the defendant to file objections and in the meantime temporarily restrained him from directly or indirectly publishing, or posting any defamatory remarks against the applicant through print or electronic media.

The case has been listed for the next hearing on 2 November next month. (KNT)
