

Srinagar, June 3, KNT: The High Court of Jammu and Kashmir and Ladakh has upheld the preventive detention of Tahir Riyaz Dar under the Public Safety Act (PSA), citing his alleged role in providing logistical support to banned militant groups Lashkar-e-Toiba (LeT) and The Resistance Front (TRF), and in inciting local youth towards subversive activities.
Dismissing a petition challenging the detention, Justice Rajesh Sekhri noted that the order was grounded in a “reasonable prognosis” of Dar’s future conduct, based on his past involvement and current security context. The court ruled that the preventive detention was legally valid and did not warrant interference under Article 226 of the Constitution, which grants limited scope to assess the adequacy of such preventive measures.
Justice Sekhri further observed that the grounds of detention were specific, relevant, and communicated to Dar in a language he could understand. He emphasized that the detaining authority had reached its decision with “subjective satisfaction,” supported by detailed inputs justifying the use of Section 8 of the PSA to avert further threats to public order.
